2. Limitations

Our shipments are carefully inspected before leaving the warehouse. If you are not satisfied with your purchase, please follow our return instructions.
The Seller will not be responsible for damage or direct loss suffered by the Buyer due to negligence, breach of contract, or excessive pricing.
The Seller is not liable for any indirect, economic, or third-party losses caused due to delay, negligence, or misrepresentation.
Orders placed on Live Plant are considered as acceptance of these Terms & Conditions.
The Seller reserves the right to cancel or reject any order without providing a reason.

3. Severance

Live Plant may monitor user postings and reserves the right to remove inappropriate content or report to legal authorities.
Invalid or unauthorized content (violating copyright, trademark, privacy, or law) is strictly prohibited, and users will be held accountable.
Users indemnify Live Plant, its officers, employees, and affiliates against claims, damages, and liabilities caused by misuse of the website.
Live Plant reserves the right to terminate or restrict access without prior notice in case of a breach of T&C.

4. Warranty

Goods delivered must match their description on the website unless the Buyer approves changes in writing.

5. Price, Payment & Delivery

Prices are listed inclusive of applicable taxes.
Orders are usually dispatched within 24 hours, subject to availability. Delivery timelines may vary depending on courier partners.
Cash on Delivery (COD) is applicable for eligible home delivery orders.
Risk and ownership transfer to the Buyer once the invoice is generated.
Errors in pricing or description may be corrected, and the Seller reserves the right to cancel such orders.

6. Force Majeure

Neither party is liable for delay or failure due to events beyond reasonable control (e.g., strikes, natural calamities, war, accidents, or raw material shortages). In such cases, delivery timelines may be extended.

7. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of India. Legal disputes shall be subject to the jurisdiction of courts in Pune/Mumbai only.

8. Membership Eligibility

Users must be capable of entering legally binding contracts under the Indian Contract Act, 1872.
Minors (under 18 years) are not allowed to register or transact.
Live Plant reserves the right to terminate accounts if ineligible users are discovered.

9. User Account & Responsibilities

Users are responsible for maintaining confidentiality of login credentials.
Providing false, incomplete, or inaccurate information may result in suspension or termination.
Personal data will be used in line with our Privacy Policy.

10. Communications

15. Privacy

Your personal information will be protected under the Information Technology Act, 2000. If you object to sharing data as per law, you must discontinue use of the website.

16. Mandatory Declaration (Seeds & Nutrients)

By purchasing seeds or nutrients, you agree that they will not be resold, misused, or used for anti-national activities. All products must be handled responsibly.

17. Risk of Loss

Risk of loss passes to the Buyer once goods are handed to the carrier.

18. Product Descriptions

While we attempt accuracy, Live Plant does not guarantee that all product descriptions are complete, reliable, or error-free. Products not matching the description may be returned unused.

19. Pricing / Errors

In case of typographical or pricing errors, Live Plant reserves the right to correct or cancel orders. Refunds will be processed within 10–15 business days.

21. Hazardous Garden Chemicals Disclaimer

Some gardening products may contain fertilizers, pesticides, or chemicals that are harmful if misused.
These must not be used for food, feed, or personal purposes.
Dispose of containers responsibly at a recycling facility, not in drains or general waste.
Live Plant is not liable for accidents, misuse, or improper disposal.
We encourage eco-friendly alternatives like organic compost and natural fertilizers.

22. Final Terms
